1. About LearnLivy

LearnLivy ("we," "us," or "our") is an educational tutoring company headquartered in Colorado, providing online and in-person tutoring services to K–12 and college students across the United States. These Terms of Service govern your access to and use of our website and services.

2. Eligibility

Our services are available to students of all ages. If you are under 18, your parent or legal guardian must agree to these Terms on your behalf. By using our services, you represent that:

• You are at least 18 years old, or have parental/guardian consent
• You have the authority to enter into this agreement
• All information you provide is accurate and complete

3. Services

LearnLivy provides personalized tutoring services including, but not limited to:

• One-on-one academic tutoring (Math, Science, English, Foreign Languages, and more)
• SAT, ACT, and AP Test Preparation
• College Counseling and Application Assistance
• Study skills coaching

Sessions may be conducted online via video conferencing or in-person depending on availability and agreement. We reserve the right to modify or discontinue any service at any time with reasonable notice.

4. Booking and Scheduling

• Sessions must be booked in advance through our website, email, or phone.
• We will confirm your booking within 24 hours of your inquiry.
• Session times are subject to tutor availability.
• We reserve the right to reassign a tutor if necessary, with notice provided as soon as possible.

5. Cancellations and Rescheduling

• Cancellations with 24+ hours notice: Full refund or rescheduling at no charge.
• Cancellations with less than 24 hours notice: The session fee may be charged.
• No-shows: Sessions not attended without notice will be charged at the full session rate.
• Tutor cancellations: If we need to cancel a session, we will provide a full refund or reschedule at no cost to you.

6. Payments and Fees

• Pricing is provided upon inquiry and may vary by subject, level, and session length.
• Payment is due prior to or at the time of the session unless a package has been purchased.
• We accept major credit cards and other payment methods as listed at checkout.
• All fees are in U.S. dollars.
• Packages and prepaid sessions are non-refundable unless LearnLivy cancels without rescheduling.

7. User Conduct

When using our services, you agree to:

• Treat tutors and staff with respect and professionalism
• Not engage in academic dishonesty or request assistance with cheating or plagiarism
• Not share tutor contact information without permission
• Not record sessions without the prior written consent of all parties
• Provide a safe and appropriate environment for online or in-person sessions

We reserve the right to terminate services, without refund, to any user who violates these conduct standards.

8. Intellectual Property

All content on the LearnLivy website — including text, graphics, logos, and materials — is owned by LearnLivy and protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or use our content without prior written permission.

Materials created by tutors during sessions (notes, worksheets, etc.) are provided for the student's personal educational use only and may not be resold or redistributed.

9. Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind, express or implied. While we strive for excellent results, LearnLivy does not guarantee specific academic outcomes, test score improvements, or college admissions results. Academic success depends on many factors including student effort and engagement.

10. Limitation of Liability

To the fullest extent permitted by law, LearnLivy and its tutors, employees, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of our services. Our total liability for any claim shall not exceed the amount you paid us in the 30 days preceding the claim.

11. Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully.

12. Third-Party Services

Our website and services may integrate with third-party tools (e.g., video conferencing platforms, payment processors). Your use of those platforms is subject to their own terms and privacy policies. LearnLivy is not responsible for third-party services.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Colorado.

14. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of significant changes by posting the updated terms on this page with a new effective date. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
